Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the Germain Toyota Dealership, located on Scarborough Boulevard in Columbus, Ohio there was a struck-by and crushing hazard from a defective 2-post automobile lift manufactured by Forward Manufacturing. The #4 Lift in the Automotive Shop had an altered pull rod on one post for the lift latch assembly, that prevented the latch from engaging and transmitting the weight onto the load locks. This created a situation where all weight was kept on the hydraulic system rather than the load locks. b.At the Germain Toyota Dealership, located on Scarborough Boulevard in Columbus, Ohio there was a struck-by and crushing hazard from a defective 2-post automobile lift manufactured by Forward Manufacturing. The #13 Lift in the Automotive Shop had an altered pull rod on one post for the lift latch assembly, that prevented the latch from engaging and transmitting the weight onto the load locks. This created a situation where all weight was kept on the hydraulic system, rather than the load locks. Among other methods, one feasible method to correct this hazard is to implement an inspection procedure as outlined in ANSI/ALI ALOIM-2000, Standard for Automotive Lifts, section 5.6.2.16.e
