Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being seriously injured or killed by motor vehicles while crossing a high speed highway. Location - Ward Hill Overpass, I-495, Haverhill, MA 01830 On or about 06/22/10, employees were exposed to being struck by motor vehicles when they were moving construction materials across the highway and when crossing the highway to use the portable lavatory. ABATEMENT NOTE: One feasible and acceptable abatement method to correct this hazard is to move all construction materials by vehicle to the other side of the highway utilizing the State Police Detail vehicle for safety and to locate the portable lavatory on the same side of the highway as the employees. Abatement certification required within 10 days after abatement. This certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.
