Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazards of being crushed or death by staging/scaffold collapse: Jobsite: The employer did not ensure through visual observation, providing appropriate training and instruction that the employee, who was hand signaling to the crane operator, verified and ensured that the area in and around the hoisting scaffolding/scissor's lift was clear of obstruction including the hoisting apparatus prior to hand signaling "up and/or down". On or about August 4. 2010, the lower leg/part sling of the multiple lifts snagged under the scaffold/scissor's lift during hoisting up, causing the scaffold to topple. One of employees sustained serious injuries from the incident.
