Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a crushed by hazard from an elevated load.
a) Employees delivering materials were exposed to crush by hazards, in
that, no
procedures were in place for the safeguarding of drivers while the
delivered materials
are being unloaded from the trucks.  Bundles of steel were unloaded using a
Mitsubishi forklift, model number FG30N, at the receiving area located at
3804
Sydney Road Plant City, Florida 33566. A bundle fell from the flatbed
truck crushing
to death the truck driver who was at the unloading zone, on or about
06/08/2010.
Abatement Note(s): General methods of control applicable in these
circumstances may
include, but are not be limited to, the following:
a.Engineering Controls:
i.Do not allow truck drivers to be around the truck while
materials are loaded and / or unloaded.
ii.Installation of stanchions along the side of the flatbed trailer
opposite from the side where off-loading occurs.
b.Administrative Controls:
i.Develop and implement a policy to identify the crushed-by
hazards, to include a requirement that personnel stay out of the
"fall zone" of product during unloading and loading
ii.Provide information and training to employees about crush by
hazards and means of recognizing and limiting their exposure
