Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about 06-03-10 in the right rear storage section of the store, an employee was elevated on a wooden pallet suspended on the forks of a Linde-Baker walkie forklift truck model (EWS40) to access material off the top shelves. The employee was without the use of fall protection when he fell to the ground at a height greater than 10 feet sustaining serious body and head injuries.
