Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a vehicular struck by hazards: a) At the time of the inspection, one laborers left the job site in the highway median to retrieve equipment in the project staging area by crossing the active highway. As a result the employee was exposed to high speed vehicular traffic in a blind spot for vehicle operators. The following problems were found; 1. No reflective clothing worn by employee exposed to high speed vehicular traffic on I-55 just past exit 290C. 2. Traffic attenuation warning and pedestrian crossing was not provided for the temporary use of the highway as a pedestrian crossing area. One method of abatement to correct this apparent hazard is to require employees to wear high visibility apparel in the vicinity of vehicular traffic to access the project staging area. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).n
