Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) Site - Back yard - Tree: The employer failed to properly evaluate a dead tree and allowed an employee to climb the tree which fell. The tree showed visible signs of damage such as a canker with a 3 to 4 inch hole leading into the tree, along with a vertical crack near the canker, The employee was exposed to a fall of approximately 65 feet to the ground. Among other methods, one feasible abatement method includes: The employer shall follow the industry guidelines and the ANSI standards allowing for proper assessment of dead trees and avoiding climbing the trees if the assessments show they are not safe to climb. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
