Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from vehicular traffic. a) Workers were exposed to being struck by oncoming motorists while conducting lawn maintenance service on roads and highways. No warning signs or traffic control devices were employed to warn motorists of the need to take precautions due to the presence of a lawn maintenance crew in the area. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED One feasible abatement method used by this industry is to develop written procedures and train employees on the safe work practices during landscaping work on roadways based on the U.S. Department of Transportation, Manual on Uniform Traffic Control Devices (MUTCD).
