Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, the use of seat belts by employees operating forklifts was not enforced, exposing employees to crushing injuries in the event of a forklift tip-over or other accident: a) Production area: The operator of a Toyota forklift was exposed to a tip over hazard when he was not wearing a seat belt while moving stacks of pallets. Another means of abatement is to observe powered industrial truck operators to determine if trucks are being operated safely and conduct employer/employee interviews to verity training program implementation. ABATEMENT DOCUMENTATION AND CERTIFICATION NOT REQUIRED
