Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were operating a forklift that did not have its seatbelt installed exposing them to crushing injuries in the event of a forklift tip-over or other accident. a) Site - Warehouse: Employees were operating a forklift that did not have a seatbelt installed, thus exposing them to crushing injuries in the event of a forklift tip-over or other accident. One feasible and acceptable abatement method includes but is not limited to the following: The employer must take the forklift out of service and install the seatbelt. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
