Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
a) The employees used the guardrails of two Skyjack scissor lifts to
elevate and support
the HVAC duct pipes that were lifted approximately 20 feet into the
ceiling of the Art
Room of a high school under construction and were exposed to tip over,
struck-by and
fall hazards of at least twenty feet.  The employer failed to secure
approval from the
manufacturer to use the guardrails of the scissor lifts to elevate and
support the duct
pipes.
A feasible abatement method, among others, would have been to use a
superlift that
could be extended at least 24 feet above ground.
