North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by chain saw hazards: a)arboricultural site, 9503 Northdowns Lane, Huntersville, NC, the arborist standing in the crotch of a tree, 6-feet above ground level, drop-started his chain-saw to notch and cut tree limbs. b)arboricultural site, 9503 Northdowns Lane, Huntersville, NC, the ground worker drop-started his chain-saw to limb and buck tree limbs on the ground. Among other methods, one feasible and acceptable abatement method to correct this hazard is for the chain-saw operator to safely start the chain-saw with two points of contact. "Two points of contact" means that the saw is securely held at two points while one hand is used to pull the starting cord. For example, the operator may hold the saw firmly in place with one hand for one point of contact, while the saw is held between the operator's legs for the second point of contact. The operator's other hand is used to pull the starting cord. REFERENCE: AMERICAN NATIONAL STANDARD INSTITUTE (ANSI) Z133.1- 2006, Safety Requirements for Arboricultural Operations, Chain Saws, 6.3.5: When starting a chain saw, the operator shall hold the saw firmly in place on the ground or otherwise support the saw in a manner that minimizes movement of the saw when pulling the starter handle. The chain-saw shall be started with the chain brake engaged. Drop-starting the saw is prohibited.
