Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized
hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Employer Bellas Artes de Caguas Corp - did not have a protocol to handle
domestic violence
in the workplace, as required by the Act for the Implementation of a
Protocol to Handle
Domestic Violence Situations in the Workplace or Place of Employment, Act
No.217 of
2006.The protocol only had the blanks for requesting protection, but was
missing parts to fully
comply with the implementation required, it did not mention who was going
to administrate the
program, what employees were cover and in case of an incident what was to
be done by the
employer, among others.
Among other methods, one feasible and acceptable method to correct this
hazard is to develop
a written protocol to handle domestic violence in the workplace that
complies with all the
requirements, and provide training to all the employees. Information is

references provided during the inspection.
Patrono "Bellas Artes de Caguas Corp." - no tenia un protocolo para
manejar violencia
domestica en el lugar de trabajo, segun requerido por la Ley para la
Implantacion de un
Protocolo para Manejar Situaciones de Violencia Domestica en el Lugar o
Sitio de Trabajo, Ley
Num. 217 de 2006. Al protocolo solamente contaba con formularios en blanco
para solicitar
proteccion, pero le faltaban partes para estar en completo cumplimiento
con
la implementacion
requerida, no se mencionaba quien administraba el programa, que empleados
estaban cubiertos
y que iba a hacer el patrono en caso de un incidente, entre otras.
Entre otros metodos, un metodo factible y aceptable para corregir este
riesgo es desarrollar un
protocolo escrito para manejar violencia domestica en el lugar de trabajo
que este en
cumplimiento con los requisitos y proveer adiestramiento a todos los
empleados. Informacion
