Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/caught-between hazards and related crush injuries from falling materials as a result of working under a suspended load. (a)Westward Dough Operating Co., LLC dba Krispy Kreme & 1051 E. 120th Ave, Thornton, CO 80233: On or before July 21, 2010, employees were exposed to injury in that,they were allowed to work under a suspended load. During the weekly Fryer Cleaning/Boil Out procedure, employees were allowed work under the suspended fryer/conveyer assembly in order to remove debris from the oil vat. This condition exposed the employees to struck-by/caught-between hazards related to a falling suspended load weighing approximately 500 lbs. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement Certification Letter"). This issue is addressed in ASME B30.21-2005, Manually Lever Operated Hoists, Section 21- 1.8.3(q), "The operator should avoid carrying loads over people" and in the Operating & Maintenance Instruction for Coffing Hoists MA Series from Duff-Norton, Publication Part No. MA-680-2, page 31, "Do not lift loads over people" and "Do make sure all persons stay clear of the supported load." Among other methods, one feasible and acceptable abatement method to correct this hazard is to use stands or other stationary, fixed devices to support the load, rather than use the hoist to suspend the load above the employees while they perform work underneath.
