Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards while working within a tree.
A)193 Wales Avenue, River Edge-NJ: An employee was exposed to a fall
hazard
of approximately 35 feet while working in a tree performing branch removal
without being secured by the use of fall protection, on or about August
3rd, 2010.
Abatement Note: Among other methods, one feasible and acceptable method to
correct this
hazard is to :
1. Follow the requirements in ANSI Z133.1-2006, section 8.1.19 which
states; The arborist shall
be secured while ascending the tree.  The arborist shall be tied in once
the work begins and shall
be tied in until the work is completed and he or she has returned to the
ground.  The arborist
shall be secured when repositioning the climbing line.
2. Assign a monitor on the ground to observe the employees in the tree to
ensure that they are
tied off at all times.
