Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard from an elevated platform of an order picker where employees did not use fall protection: a)380 Allwood Road, Clifton, NJ: Employees were exposed to fall hazards from order picker fork lifts, where employees were not using a body belt or other means of fall protection, on or about 11/22/2010. ABATEMENT NOTE: One feasable and acceptable means of abatement, among others, is to use the body belt and lanyard that is provided and enforce the company policy to wear the body belt when the employee steps onto the order picker.
