Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a) South Side Stairwell # 5 adjacent to (Area C), 201 Main Ave, Clifton, NJ: Employees using a Max Jack stand to move a 40ft chill water pipe across a floor not free of obstructions. The floor contained an approximate 1 1/2" height difference due to added plywood flooring. Condition noted on or about 10/14/2011. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to follow the manufactures intended warnings and guidelines as contained in the Sumner Operator's Manual. Instructions for loading a beam or pipe (Page 3) Always use Beam Max and Max Jack stands on a firm, level surface such as pavement or hard flooring.
