Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that:  Employees were exposed to being caught/crushed by a
moving
elevator:
Location: 711 Amsterdam Ave, New York, N.Y.
On or about 7/5/2010
a)
The Sidewalk elevator IS3805 used by maintenance personnel to remove
refuse twice a day
from the building basement was not being inspected, maintained, and used
safely:
The elevator door/ gate interlocks were damaged and not working. The
interlocks were not
repaired, as was required. The employer continued to use the elevator by
using a string to
bypass the door interlocks.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
Comply with industry standard ANSI A17.3-2002 Safety Code for Existing
Elevators;
Section 2.7.1, and 3.4.2 (a) which has specific requirements that
elevators shall be equipped
with door and car gate interlocks.
Note:  The employer is required to submit abatement certification for this
item in
accordance with 29  CFR 1903.19.ce
