Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being ejected or falling from the operator's seat of a powered industrial truck: (a) Loading dock - on or about 29JUL10, an employee was observed operating a Toyota electric powered industrial truck with out wearing the seatbelt. ABATEMENT NOTE: Among other methods, one acceptable means of abatement would be to require the use of the seat belt in accordance with the Consensus Standard ANSI/ITSDF Safety Standard for Low and High Lift Tucks B56.1-2000, Section 5.3.19 which states: "An active operator protection device or system, when provided, shall be used."
