Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to being struck by a falling load:
Jobsite:  The employer did not ensure through providing not only
appropriate tools and
equipment, but also training and instruction that the light pole that was
lifted and lowered by the
Caterpillar THE material handling equipment with a synthetic web was
positively secured to
prevent the pole from slipping off and/or falling.
On or about 08/27/2010, the light pole slipped off from the web sling and
fell while being
maneuvered with the above equipment and struck an employee on the ground.
The employee
sustained severe injuries from the incident.
Among other methods, one feasible and acceptable means of abatement is to:
1. Comply with the 29 CFR 1910.178, subsection (o), "Loading".
2. Comply with the 29 CFR 1910.184, Slings.
3. Comply with other applicable and industry recognized standard and
practice.
4. Utilize other safe and effective techniques.
