Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an improperly used and functioning Bobcat Skid Steer
Loader that could result
in crushing and fall injuries to employees:
a) In area of outside dumpster - On or about October 19, 2010, employees
were
operating a Bobcat Skid Steer Loader without a working ignition switch
which was then
bypassed, inoperable brake lights, a broken back-up alarm and hydraulic
controls that
were not functioning properly.
b) In area of outside dumpster - On or about October 19, 2010, an employee
was riding
in the bucket of a Bobcat Skid Steer Loader to facilitate the dumping of
trash into the
dumpster.
One feasible and acceptable mean of abatement includes following
operator's safety instructions
as shown in the Association of Equipment Manufacturer's Safety Manual for
Skid Steer Loaders.
This would include the following:
1) Inspecting the loader at the beginning of each workday to ensure all
systems are in good
operational condition.
2) Not operating the loader until all deficiencies noted during the
inspection above are corrected.
3) Follow the manufacturers warning to not permit riders or use the
bucket, forks, or other
attachments as a work platform or personnel carrier.
No abatement certification or documentation required.tion
