Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a serious fall hazard: a) Warehouse area - On or about December 16, 2010 the employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitate the use of personal protective equipment (PPE). Employees were exposed to an unprotected fall hazard from a height 10-15 feet above the floor. b) Warehouse area - On or about December 16, 2010 employees were using a Yale Product Picker to place and remove stock from racking system platforms located at a height 10-15 feet above the floor without guard railings or a fall protection system in place. Abatement note: a) Among other methods one feasible and acceptable method to correct this hazard would be to: Ensure that employees are provided with the appropriate protective equipment and follow the Industry consensus standard, ASME B56.1-2005 Safety Standard for Low Lift and High Lift Trucks. Section 4.17.2(c) of ASME 56.1-2005 requires that whenever an operator-up high lift truck is used to elevate personnel, restraining means such as railings, chains, cable, body belt(s) with lanyard(s), or deceleration devices, etc. are in place and properly used. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
