Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a falling from the racking system platform while placing
and removing stock:
a) Warehouse area - On or about December 14, 2010 employees
were using a Crown Cherry Picker to place and remove stock from
racking system platforms, while climbing onto and working from
a pallet, at a height 15-25 feet above the floor without guard
railings or a fall protection system in place.
Among other methods one feasible and acceptable method to correct this
hazard would be to:
Ensure that employees are provided with the appropriate protective
equipment in accordance with
ASNI/ITSDF B56.1-2009, Safety Standard for Low Lift and High Lift Trucks.
Paragraph 4.17.1 of ASNI/ITSDF 56.1-2009 requires that whenever a work
platform
is used to
elevate personnel additional requirements from Paragraphs 4.17.2 and
4.17.3 shall be met.
Paragraph 4.17.2(c) requires restraining means such as railings, chains,
cable, body belt(s) with
lanyard(s), or deceleration devices, etc. need to be in place and are
properly used.
Paragraph 4.17.3(b) requires that platform attachment means are applied
and the platform is
securely attached to the lifting carriage or forks.
Paragraph 4.17.3(c) requires that when the lifting carriage and/or forks
are supporting the
platform used to elevate personnel, the lifting carriage and/or forks are
secured to prevent them
from pivoting upward.
Paragraph 4.17.3(h) additionally requires that before elevated personnel,
mark area with cones
or other devices to warn of work by elevated personnel.
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, date
and method of abatement,
and states employees and their representatives were informed of this
abatement.  Abatement
documentation shall include documents demonstrating that abatement is
complete, such as
evidence of the purchase or repair of equipment, photographic or video
evidence of abatement
or other written records.
