Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck by hazards from the improper use of an aerial lift: a) All American Glazing- On or about April 21, 2011, an employee was seriously injured when a JLG Model 600S aerial lift tipped over due to the lift being used as a crane to move a crate of glass weighing approximately 763 lbs. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. ABATEMENT NOTE: One feasible means of abatement is to employ the use of proper material handling equipment designed with the intent to hoist and place loads. This violation finds the aerial lift was used in a manner not permitted by the JLG 600S Operators manual as the lift was not rated for the lifting of overhanging loads. The weight capacity of the platform was also exceeded. ANSI A92.5-1980, American National Standard for Boom- Supported Elevating Work Platform Section 13.2 During Operation: requires use of work platform in accordance with the manufactures/owner's operating instructions and safety rules.
