Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries associated with the rollover of a lift truck without the use of an operator restraint system: a) Doylestown Electric - On or about October 4, 2011 an employee was observed unloading a tractor trailer with a TCM forklift (Model FCG15F9, Serial #A12R00312) without using the manufacture's provided seatbelt. Among other methods, one means of feasible and acceptable methods to correct this hazard would be to ensure that all forklift operators utilize the restraint devices provided on the forklift as stated in ITSDF B56.1-2005 (Reaffirmation of ASME B56.1-2005) Safety Standard for Low Lift and High Trucks, section 5.3.19. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.tives
