Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall, crushing and drowning hazards while operating a
Genie S60 aerial lift on
a barge during an extended period up to and including December 20, 2011.
b) Employees misused the aerial lift as a crane under direction of
management to hoist
equipment such as product hoses and fuel drums. Warnings in the operator
manual prohibit using
the lift on an unstable, moving, or mobile surface or using the aerial
lift with overhanging loads
attached to the lift.
The aerial lift was placed on the barge without written approval by the
manufacturer as required
by ANSI A92.5 (American National Standard for Boom-Supported Elevated Work
Platforms),
1992, sections 7.11.12 and 8.10.13., and misused as a crane as prohibited
in sections 7.11.11
and 8.10.12.
Among feasible methods of abatement would be to comply with all sections
of ANSI A92.5
(American National Standard for Boom-Supported Elevated Work Platforms),
1992 and the
equipment operator manual; and/or utilize appropriate ships gear designed
for use on a vessel.
Abatement certification required within 10 days after abatement date.  The
certification shall
include a statement that abatement is complete, date and method of
abatement, and states
employees and their representatives were informed of this abatement.
