Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about August 20, 2010 and prior thereto, employees operating all terrain vehicles (ATV's) in the yard were not required to wear head protection such as a Department of Transportation (DOT) approved helmet or Snell approved helmet for hazards associated with being thrown from an ATV, and or impact with the roadway, ground and objects such as vehicles and stacks of rail ties. Among other methods, one feasible and acceptable means of abetment would be to provide and require the use of a Department of Transportation (DOT) or Snell approved helmet when operating an ATV. On or about August 20, 2010 and prior thereto, employees operating all terrain vehicles (ATV's) in the yard were not required to wear head protection such as a Department of Transportation (DOT) approved helmet or Snell approved helmet for hazards associated with being thrown from an ATV, and or impact with the roadway, ground and objects such as vehicles and stacks of rail ties.
