Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Potential evolution of an explosive concentration of hydrogen sulfide gas above liquid sulfur in dip tanks, including but not limited to Dip Tanks #2 and #3, and there were no means to detect the concentration of hydrogen sulfide nor to prevent an explosion. Among other methods, some feasible and acceptable methods to correct this hazard include but are not limited to the following: a.Equip the dip tanks with instrumentation for measuring the concentration of hydrogen sulfide over the liquid sulfur with the capability of shutting off the operation if the concentration reaches or exceeds 35 percent of the Lower Explosive Limit of hydrogen sulfide. b.Ground and bond the dip tanks of liquid sulfur. c.Connect the local exhaust ventilation systems to the fans in each system. d.Implement an inspection, testing and maintenance program, to cover such areas as potential ignition sources, electrical and mechanical equipment, and excessive heat and vibration at the fans. e.Have an individual knowledgeable about explosion hazards conduct a process hazard analysis and comply with applicable standards issued by the National Fire Protection Association (NFPA), including NFPA 655, Standard for Prevention of Sulfur Fires and Explosions.
