Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recog nized hazards that were causing or likely to cause death or serious phyical harm to employees in that employees were exposed to the hazard of: The employer did not ensure that employee(s) wear safety belts while operating a forklift. This v iolation occurred on or about 03/31/11 at 4607 Veterans Blvd., Metairie, Louisia na where an employee was using a forklift to unload material from a flatbed truc k while not wearing the safety belt. The surface the forklift was operating on w as uneven. This condition exposed the employee to a crushing hazard. A feasible and useful means of abatement would be to ensure that employees use the installe d seat belts on the forklift to eliminate the hazard of entrapment of the operat or's head and/or torso between the truck and ground in the event of a tip over. This hazard is identified in paragraph 7.41 of ANSI/ITSDF B56.1-2009. Thomas Mata was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 308774983, citat ion number 01 and was affirmed as a final order on 06/28/07, with respect to a w orkplace located at 2425 Morning Vista, Bartlett, TN. 38134.
