Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free fr om the rollover hazard of operating an aerial lift that did not have a pre-start inspection performed and on a slope outside the manufacturers maximum slope rat ing: This violation occurred on or about April 28, 2011, where an employee was e xposed to a rollover hazard while operating an aerial lift that had not been pre - start inspected on a slope outside the manufacturers maximum slope rating. ABA TEMENT NOTE: Among other methods, feasible and acceptable abatement methods to c orrect these hazards would be to 1. Inspect the workplace for possible hazards s uch as drop-offs and slopes according to ANSI/SIA A92.6 and/or the Genie operato r's manual. 2. Perform pre- start inspections before use each day according to t he ANSI/SIA A92.6 and/or the Genie operator's manual.
