Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to his
employees in that they were exposed to the hazards of crushing:
On or about 11/30/2011, on the outer west side of the building, the
employer did not ensure that
his employee utilized the seat belt provided by the manufacturer while
operating a Caterpillar
CB-434D Paving Compactor (ID# CATCB434CCNH00801) equipped with a Roll-Over
Protective System (ROPS) to put the binding on the asphalt; the employee
was exposed to a
crushing hazard.
Among other methods, one feasible and acceptable abatement method would be
to ensure that
the operator(s) of the Caterpillar CB-434D Paving Compactor have read and
understand the
safety, operation and maintenance instructions in the manual prior to
operation, and utilize the
seat belt provided, such as specified by the Caterpillar CB-434D Paving
Compactor Operation
and Maintenance Manual.
Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the
abatement date, the
employer must submit documentation describing actions it is taking to
establish, communicate,
and implement procedures to ensure that each employee who operates a
Caterpillar CB-434D
Paving Compactor utilizes the seat belt provided.
