Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: This violation occurred on or about December 2, 2010 at the ELLIE LEASE-WELL #1415 where the employees were exposed to fire and/or explosion hazards due to employee(s) using a blow out preventer that had not been maintained, serviced, and/or inspected prior to use. Among other feasible methods to correct the identified hazard, one method is for the employer to ensure that blow out preventers (BOP) are inspected and tested as per American Petroleum Institute (API) Recommended Practices. RP54 Paragraph 6.4.3 states that: "Blowout Prevention equipment, when required, should be installed, operated, and maintained in accordance with API RP 53". In addition, RP54 Paragraph 6.4.7 states that: While in service, blowout prevention equipment should be inspected daily and a preventer actuation test should be performed on each round trip, but not more than once per 24-hour period. Notation of actuation tests performed should be made on the daily report. Annular blowout preventers should be tested in accordance with the manufacturer's recommendations". Employees engaged in oil well servicing operations were exposed to fire and explosion hazards in the event of BOP failure. Pursuant to 29 CFR 1903.19 within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that blow out preventers are maintained, serviced, and/or inspected as per API practices and manufacturer's recommendations.
