Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employement and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that employees were exposed to hazardous conditions when the employee was exposed to fall hazards: a) Front of Main Building: A company employee, not supplied with a personal fall arrest system, was exposed to fall hazards in excess of 96 inches to the ground surface below when working from an unsecure, wooden pallet raised on the forks of a forktruck. Condition observed by CSHO on or about 10/12/10. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
