Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from a vehicle lift: (a)At Snaps Super Shop car lift area in Phenix City, Alabama: On October 5, 2010 and at times prior the employer did not ensure secondary load securing devices were in proper working order, exposing employees to struck-by hazards. (b)At Snaps Super Shop car lift area in Phenix City, Alabama: On October 5, 2010 and at times prior the employer failed to perform periodic inspections of the vehicle lift as required by ANSI/ALI ALOI:2008 Section 5.1, exposing employees to crush hazards. (c)At Snaps Super Shop car lift area in Phenix City, Alabama: On October 5, 2010 and at times prior the employer failed to perform and document operator training on the vehicle lift as required by ANSI/ALI ALOI:2008 Section 4.3, exposing employees to struck-by hazards. (d)At Snaps Super Shop car lift area in Phenix City, Alabama: On October 5, 2010 and at times prior the employer failed to perform and document repairs to the vehicle lift such as, but not limited to repairs to the leaking upper hydraulic ram on lift as per ANSI/ALI ALOI:2008 Section 6.2.4, exposing employees to struck- by hazards. Among other methods, a feasible means of abatement would include having the secondary load securing device repaired allowing it to operate properly, conducting periodic inspections of the vehicle lift, complete and properly document repairs to the lift, and properly performing and documenting lift training for each employee.
