A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to their employees, in that the employer failed to ensure that work practices and explosion prevention systems were adequate to prevent milk powder fires/explosions. The facility manufactures, processes, and handles explosive dried powdered milk products (whey protein concentrate, lactose powder, milk protein concentrate, and non- fat dry milk powder). a) United Dairymen of Arizona, 2008 S. Hardy Drive, Tempe, Arizona, 85282: Employees working in the Lactose Bag Filling Room and Non-Fat Milk Bag Filling Room used compressed air to clean milk powder accumulations from equipment thereby creating a potentially explosive/flammable atmosphere. b) United Dairymen of Arizona, 2008 S. Hardy Drive, Tempe, AZ: Records specific to the inspection and testing of explosion prevention systems were not made available to ADOSH. Inspection and testing of explosion prevention systems are intended to verify that such systems are functional should excessive heat/fire conditions occur within processes where explosive dust concentrations normally exist.
