A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to their employees, in that employees were not adequately trained in the handling and dispensing of Liquefied Natural Gas (LNG) such that they failed to recognize systemic operational hazards resulting in repeated employee exposure to LNG hazards. That is, employees tasked with managing and operating LNG fueling operations failed to recognize systemic problems with LNG dispensing system components that resulted in recurring leaks and subsequent employee exposure to cryogenic liquid, oxygen deficient and flammable environments. a) Veolia Transportation Services, Inc., 2010 W. Desert Cove Avenue, Phoenix, AZ, 85029: Between January 1, 2010 and August 31, 2010 at least 16 LNG leaks with associated emergency shutdown alarms occurred. Management responsible for LNG fuel operations failed to investigate and develop corrective actions to address recurring LNG system leaks and associated hazards posed to employees including burns from cryogenic LNG, fires, and/or exposure to oxygen deficient atmospheres. Management charged with handling and dispensing LNG were not adequately trained such that they would recognize the potentially serious nature of LNG releases and subsequent actions necessary to ensure protection of life, property, and the environment. Pursuant to NFPA 57 Liquefied Natural Gas (LNG) Vehicular Fuel Systems, persons employed in the handling and dispensing LNG shall be trained in proper handling and operating duties and procedures. Training shall be conducted at least every two years. Training shall include: 1) Information on the nature, properties, and hazards of LNG in both the liquid and gaseous phases; 2) Specific instructions on the facility equipment to be used; 3) Information on materials that are compatible for use with LNG; 4) The use and care of protective equipment and clothing; 5) Standard first aid and self-aid instructions; 6) Response to emergency situations such as fires, leaks, and spills; 7) Good housekeeping practices; 8) The emergency response plan; and 9) Evacuation and fire drills.
