Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to serious injuries or death from an unstable cement mixer.
Worksite: The Essick EM-120M Mortar Mixer, used to mix cement was not only
modified in
an unsafe and unstable manner having a narrow base width then the
manufacturer's specification,
but also placed on unsecured pieces of concrete cement blocks to increase
the operating height.
On or about November 15, 2010, the above cement mixer tipped over while an
employee was
trying to free up the mixing blade from "over-filled tumbler with dry
cement" and fell onto the
employee's right leg. The employee sustained severe injuries from the
incident.
Among other methods, one feasible and acceptable method to correct the
hazard is to:
1. Consult with the equipment manufacturer prior to making modifications.
2. Positively secure the equipment especially when elevating the center of
gravity with a narrow
base width.
3. Utilize engineering feasibility to control of hopper chute per the
tumbler size of the cement
mixer.
4. Train the operators/employees required to operate the equipment.
5. Utilize other effective and safe engineering technologies.
