North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fall and struck-by hazards:
a)facility, a wooden pallet was used as a personnel platform on a Clark
forklift to
lift an employee approximately 10 feet to change a light bulb.  The pallet
did not
have a slip resistant floor, restraining means (such as a guardrail or
personal fall
protection devices), secure attachment of platform to the forks, and
protection for
personnel from moving parts of the forklift.
One feasible method of abatement includes, but is not limited to, ensuring
that platforms
used to lift personnel are in accordance with the American Society of
Mechanical
Engineers (ASME) B56.1-2004 Safety Standard for Low Lift and High Lift
Trucks.
