Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to crushed-by and fall hazards: (a)On or about 11/02/10 - At the creek bed between Bryant Drive and Ham Road on Railroad Ave, Albertville, AL, an employee was riding on the pipe while it was being lifted by the excavator. Among other methods, one feasible and acceptable method to correct this hazard is to follow the safety precautions stated in the Komatsu Excavator Model # PC228USLC-3EO Operations Manual on page 2-16 that states "Never let anyone ride on the work equipment or other attachments."
