North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to by bypassing a safety feature of chainsaws: a)Jobsite, US Highway 19/23, Southbound, in the vicinity of Mm 22 - Throttle trigger interlock on a Husqvarna chainsaw used by groundsman was taped over with black tape, thus allowing unintended actuation of the chainsaws throttle trigger. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the recommendations of Section 6.3.2 of ANSI Z133.1-2006 that requires chainsaws to not be operated unless the manufacture's safety devices are in proper working order. This section also goes on to say that chainsaw safety devices shall not be removed or modified.
