Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a struck by hazard.
a)  Worksite: 94 Ridgedale Avenue, Florham Park, NJ
Employees, not involved in the felling operation, were exposed to being
struck by falling tree
components and were not removed from the fell pattern of the tree before
the cut back was
made.
Violation occurred on or about 10/28/2010.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS TO:
1. Direct and train all employees, not involved in the removal and/or
trimming
operation, to
stand clear beyond the length of the fell pattern of the tree when cutting
begins, in accordance
with ANSI Z133.1-2006, Section 8.2.1 and Section 8.5.3.
2. The cutter must confirm, either through visual contact or through
audible response, that all
employees are out of the fell pattern before starting the cut back.
