Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling parts from the below-the-hook lifting device which was fabricated in house to lift parts for welding. On or about March 15, 2011, employees used the device and the employer had not performed a load test to determine what was the lifting capacity of the device and legibly mark it on its main structure: Among other methods, one feasible and acceptable means of abatement would be to comply with the American Society of Mechanical Engineers, ASME B30.20-2010, Below-the-Hook Lifting Devices, Section 20-1.2.1.
