Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards:
a)  An employee was exposed to a fall hazard while working from a platform
resting on the
forks of a Hyster forklift because the guardrail on the platform did not
have a midrail.
Additionally, the platform did not indicate the maximum work load
including personnel and
equipment, the weight of the empty platform, or the minimum capacity of
the truck on which
the platform could be used in accordance with ANSI B56.1-2009, American
National
Standard for Low Lift and High Lift Trucks, Section 7.37.
b) Employees are exposed to a fall hazard while working from the "tall"
platform resting on
the forks of a forklift because the guardrail on the platform did not have
a midrail.
Additionally, the  platform does not indicate the maximum work load
including personnel
and equipment, the weight of the empty platform, or the minimum capacity
of the truck on
which the platform could be used in accordance with ANSI B56.1-2009,
American National
Standard for Low Lift and High Lift Trucks, Section 7.37.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to provide work platforms in accordance with ANSI B56.1-2009, American
National
Standard for Low Lift and High Lift Trucks, Section 7.37.

requirements of 29 CFR 1903.19(d)***
