Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing, or likely to cause, death or serious physical harm to
employees in that employees
were exposed to struck by hazards:
At this job site, the employer failed to ensure employees were visible and
protected from being struck by cement trucks while spreading out concrete
at the
edge of the driveway between two concrete trucks. The employees were not
provided with warning vests or other suitable garments marked with or made
of
reflectorized or high-visibility material. This violation most recently
occurred at
this job site in Kingsville, Texas on or about October 6, 2010.
Among other methods, feasible and acceptable methods to correct this
hazard are:
(1) provide a reflective vest/clothing shall conform to Part VI of the
Manual of
Uniform Traffic Control Devices (MUTCD), 2009 Edition; (2) Provide training
on the utilization of temporary traffic control zones marked by signs,
barriers,
and channelizing devices, and/or work vehicles.
