Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to a fire hazard: On or about October 7, 2010, and other times prior thereto, at this oilfield production site (Dehydration Unit), the employer failed to develop and implement a fire prevention and protection plan to protect employees performing maintenance and repairs on process equipment against flash fire hazards. Among others, one feasible means of abatement included developing a fire prevention plan in accordance with API Recommended Practice 74 (2001), "Recommended Practice for Occupational Safety for Onshore Oil and Gas Production Operation". Among others, critical elements would include: a)performing a job safety analysis (JSA) prior to work at a remote location b)identifying and controlling sources of ignition (e.g. static discharge, burner flames, smoking, vehicle engines, etc) c)providing effective means (e.g. LEL meter) to detect and alarm against dangerous accumulations of flammable gas in the work area d)providing fire extinguishers and keeping them readily accessible during maintenance work.
