employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to struck by hazards:
a)Back chipper conveyor loading area - the shed used to shade and provide
protection from light
rain for the operator was not level, plumb and was built from severely
warped
boards to the
point that the nails had pulled loose leaving the shed without any
structural integrity.
Abatement note: One means of abatement would be to dismantle the failing
and un plumb
structure and use sound and accepted building practices/materials in order
to replace the
structure.
