North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: crushed by hazards. a)establishment - on or about 10/11/10 an employee, was crushed by a John Deere 750 compact tractor, which was not equipped with ROPS or a seatbelt, when the tractor tipped over onto the employee as he was aerating and seeding the steep hillside of a lawn near a pond. Abatement note: A means of abatement would be that the employer equip the tractor with ROPS and a seatbelt and ensure employees follow the manufacturer's instructions provided in the operator's manual regarding the ground conditions on which the tractor can be safely operated.
