North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with working in a hot environment: a)facility - where the employer did not develop a heat stress management program for employees who were exposed to a heat index of 106 degrees Fahrenheit, to help them recognize and avoid heat stress related illnesses; and hazards associated with working in a hot environment. One feasible and acceptable abatement method, among others, to correct this hazard is to develop a heat stress management program to include elements such as the following: a)Engineering controls. b)Work practices. c)Acclimatization d)Personal protective equipment e)Employee education and training. f)Worker monitoring program Reference: American Conference of Governmental Industrial Hygienists. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of potential fire and explosion because the air material separator (dust collector) was not being maintained and operated in a manner that minimizes the escape of dust: a)facility, production - throughout the facility the dust collection system ducts had separated and in some cases were wrapped with plastic wrap and duct tape to hold the ducts together resulting in decreased airflow at the collection point allowing for dust to escape into the facility from equipment, such as, but not limited to, Mattison Lathes #2,#3 and #8, Diehl, D-4 Moulder, Nash Sander and belt sander/buffer for finials. ABATEMENT NOTE: 1)Have the dust collection system repaired to original design to minimize the escape of dust and meet the protection, venting and size requirements listed in paragraph 7.2.3.2.2 and 8.2.1.1 of NFPA 654. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of potential fire and explosion because methods were not utilized to contain combustible wood dusts created by manufacturing, handling, and processing operations from becoming airborne and combining with an ignition source: a)facility, production - where the employer did not ensure the minimization of dust clouds by allowing employees to use compressed air rated at 84 p.s.i. to clean flat surfaces and equipment. ABATEMENT NOTE: The use of compressed air shall be permitted only where the following requirements are met: 1)Area and equipment shall be vacuumed approved for a Class II, Division I, Group G in accordance with Article 502, NFPA 70, National Electric Code prior to blow down. 2)Electrical equipment not suitable for Class II locations and other sources of ignition shall be shut down allowed to cool or removed from the area. 3)Only low-pressure steam or compressed air, not exceeding a gauge pressure of 15 p.s.i. shall be used. 4)No hot surfaces or flames capable of igniting a dust cloud or layer shall exist in the area. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of potential fire and explosion from the accumulation of fugitive wood dust from the job made sander that was not equipped with a air material separator (dust collector): a)facility, job made sander/buffer - where the job made sander/buffer was not connected to the air material separator (dust collector) allowing for the accumulation of fugitive wood dust on the horizontal and flat surfaces in production. ABATEMENT NOTE: 1)Have the sander connected to the dust collection system to convey the dust and minimize the escape of dust through continuos suction. Chapter 8, paragraphs 8.1.1 and 8.1.2.
