North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to fall to lower level hazard by tipping of
vehicle-mounted telescoping aerial work
platform:
a)job site - where employee(s) were replacing a sign approximately 8' tall
by 12' wide with the
top of the sign approximately 27' above the ground from two
vehicle-mounted telescoping aerial
work platforms, and did not place ground boards of proper size under the
outrigger pads when
used on ground that was not firm due to frozen soil.
Abatement note:
One feasible and acceptable abate method, among others, to correct this
hazard was to use ground
boards of the proper size under the outrigger pads when using
vehicle-mounted
work platform on
ground that is not firm caused by, but not limited to, snow, ice, crushed
rock, or soft ground.
