North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crush injuries. a)establishment, bay #1 - where employees worked under the surface-mounted Challenger/Hennessy/Ammco vehicle lift - (Model #B4120SW-Serial #P960722843H) had a W-K Industries Air-Up Series Jack-Pneumatic Rolling Jack (unknown model number and serial number) while the guide pins were not functioning to lock the lift into place when raised. The guide pins were incorrectly positioned in such a way that the spring-loaded safety locks could not engage into the notches to prevent the lift from slipping. b)establishment, bay #1 - where employees worked under the surface-mounted Challenger/Hennessy/Ammco vehicle lift - (Model #B4120SW-Serial #P960722843H) that had a vehicle that was not chocked or blocked at the wheels to prevent the vehicle from inadvertently rolling off the lift. c)establishment, bay #1 - where employees worked under the surface-mounted Challenger/Hennessy/Ammco vehicle lift - (Model #B4120SW-Serial #P960722843H) where the safety latch locking pin on the lift was not properly seated in the latch rack. Abatement note: One feasible and acceptable abatement method, among others, to correct this hazard is to provide all operators with operator training to recognize hazards and to ensure that the lift is not used until repairs have been made.
